GENERAL CONTRACTING CONDITIONS

1. Identification of the Parties

In compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, we inform you that the website https://trenturisticosantiago.com/ is owned by Autocares Rías Baixas, SL, with CIF number B36019990, registered office at Igrexa-Salcedo, number 37, postal code 36143, Pontevedra, and contact email address arbp@autocaresriasbaixas.com. The company is registered in the Commercial Registry of Pontevedra, Volume 4012, Folio 113, entry 31, page PO7500.

2. Purpose

This document regulates the general terms and conditions that will govern the relationship between the provider, Autocares Rías Baixas, SL, and the user when browsing the website https://trenturisticosantiago.com/, and, specifically, the purchase and reservation of tourist services offered through the website, consisting of tourist train transportation services in the city of Santiago de Compostela.

Acceptance of this document implies that the user: has read, understands, and comprehends the provisions set forth herein, has sufficient capacity to enter into a contract, and assumes the obligations set forth herein.

3. Contracting Procedure

The reservation and contracting procedure can be carried out in Spanish, English, and Galician.

The purchasing procedure will follow the following steps:

  1. Access all information prior to contracting the service offered through the website.
  2. Access the ticket reservation process by clicking on the "Buy your ticket" button, where the desired date will be selected by clicking on the day on the calendar; Next, the schedule is selected, indicating the available seats in each shift. Fares are then selected based on the ages of the people for whom the purchase is being made, clearly and simply indicating which age ranges each fare covers and allowing multiple tickets to be selected for each segment. Finally, the desired seat can be selected from a diagram of the tourist train, color-coded based on availability.
  3. A summary of the selections will be displayed on the right side at all times.
  4. Both the right margin and the bottom of the page will allow the user to click "continue with payment." The buyer will have 20 minutes to complete essential personal information and indicate whether or not they wish to receive an invoice, which will be sent to the email address provided, along with their acceptance of the privacy policy and these general terms and conditions. Finally, the buyer can click "complete purchase."
  5. Access the payment gateway, enabling payment by bank card only. After this, you will receive a link to "download tickets," and the purchased tickets will be automatically sent via email.

4. Prices and Taxes

All prices shown include current VAT unless expressly indicated. The company reserves the right to change prices without prior notice, although the prices in effect at the time of purchase will be honored.

5. Cancellation and Refund Policy

The booking process can be completed with or without prior registration on the website. In the first case, a username and password will be provided to access all orders placed, via the icon in the upper right corner of the screen. The same icon can be accessed without registration, using the ID, purchase reference, and tracking number (indicated on the ticket) to manage the reservation.

Reservation management allows you to re-download tickets, change the date, time, or seat, and/or cancel your reservation. After processing, you will receive a confirmation email address. In the event of a refund, the credit will be issued to the same card used to make the payment within a maximum of 15 business days. This does not affect any administrative fees that Autocares Rías Baixas, SL may deduct as a change or cancellation fee, if duly informed.

In any case, cancellation and modification processes can be completed up to one hour before the scheduled start time of the service.

No refunds or modifications will be issued if the user does not show up at the agreed time or arrives late.

6. Rights and Obligations of Passengers

The user agrees to respect the safety regulations indicated by the staff and to maintain appropriate conduct during the journey, in particular, but not limited to:

  • No passenger will be allowed to travel standing or walking during the journey inside the train. They must remain seated in their assigned seats from the beginning to the end of the journey. At stops, passengers must wait until the vehicle has completely stopped before entering or exiting, and must wait until instructed by the staff.
  • Boarding and transportation of children under 12 years of age will not be authorized unless accompanied by a responsible adult. For children under 4 years of age, the ratio of accompanying passengers will be one for every two rows of seats in which the child is located.
  • Users must meet minimum health, sanitation, and hygiene standards necessary to avoid any risk or discomfort for other users. They must maintain appropriate conduct on the train at all times, avoiding actions that put themselves and other users at risk. Their conduct must be correct and polite, respecting the rules of coexistence.
  • Smoking, eating, or drinking on the vehicle is strictly prohibited, as is any type of conduct that poses a risk to one's own or others' health. For the comfort and safety of users, large packages, containers, or bottles containing flammable substances, as well as objects that, due to their appearance and/or condition, could disturb or affect the service or other users, may not be brought onto the vehicles.
  • Users who are intoxicated or under the influence of any narcotic substance, as provided for in the Citizen Security Law, will not be admitted, nor will those carrying weapons of any kind in accordance with the provisions of the Weapons Regulations, except for police and security forces on duty.
  • The admission of animals of any kind is prohibited, except those traveling in specific transport systems that do not occupy a seat and whose size does not exceed the width of the seat. Guide and assistance dogs (certified by centers approved for these tasks) do not have to meet the above requirements; these animals may travel alongside their owners in accordance with the applicable regulations.
  • The fundamental rights of all persons in the vehicle must be respected at all times, particularly religious beliefs and beliefs, dignity, integrity, and privacy. No one will be discriminated against on the basis of sex, race, birth, or any other personal or social circumstance. Persons displaying items, symbols, or objects that incite activities contrary to the fundamental rights recognized in the Constitution, and especially those that incite violence, xenophobia, or discrimination, will not be permitted to board the train.
  • Any damage caused by non-compliance with these rules will be the responsibility of the user.

7. Rights and Obligations of the Company

The company may cancel or modify the service due to weather, technical reasons, or force majeure, offering the customer a new date or a full refund. It may also deny access to any user who violates the rules of conduct or safety.

Under no circumstances will the number of seats offered on each journey be exceeded, and the number of seats available will be limited.

8. Data Protection

Personal data provided during the purchasing process will be processed in accordance with the Privacy Policy published on the website, in compliance with Regulation (EU) 2016/679 (GDPR) and LOPDGDD 3/2018.

9. Applicable Law and Jurisdiction

These terms and conditions are governed by Spanish law. For the resolution of disputes, the parties expressly submit to the Courts of Pontevedra.
